Terms & Conditions
Let's grab a cup of coffee and read through the small print - we know it's boring but let's get it out of the way! These terms are self contained however please feel free to contact us if something is unclear or you have a question. These Terms and Conditions are applicable for every visit (known as a session) of the Infinity website and its sub-pages (including social media, emails and other digital content from us). Please note that these Terms and Conditions also incorporate the following sections which we advise that you read.
All terms, transactions, entered contracts, deliveries and warranties are between a person and Infinity.
All content and rights in this website are owned by us.

License
The purchase of any Infinity software product permits the customer a single license for the installation (if required) and use on a designated hardware - or approved - device of said software product. The license permits the customer - and the customer only to use said software product. The ownership of the software product remains in the possession of Infinity Electronics Ltd and the license of use permitted to the customer at the time of purchase, can be revoked at any time without entitlement to a refund at a time/date at the sole discretion of Infinity Electronics Ltd, without prior need of notification to the customer.
The purchase of any Infinity product or service grants the customer the right to use said product or service within the realms of its intended use. Any detections or notifications made to - or by - Infinity Electronics Ltd can result in the immediate revoke of the granted license at a time/date at the sole discretion of Infinity Electronics Ltd, without prior need of notification to the customer.
Ownership
The purchase of any Infinity software product does not change the ownership of said product, the "deed", "title", "Intellectual Property" and "Ownership" of the software product remains the sole property of Infinity Electronics Ltd. Please see the License section within these terms to see how the purchase of software merely provides a license to use said software only.
The purchase of any Infinity product, device or physical item passes ownership of said product to the customer upon clearance of the funds amounting to the agreed sell price of the product(s) in question. The ownership of any software, firmware or other non-physical entity of the product, is not transferred to the customer. The customer is merely granted a license to make use of the necessary software and firmware in order to enable their product to function. The acceptable and allowed use and distribution of the software and firmware is agreed to by the customer when they make the purchase; should they break the allowed use and/or distribution of any items still "owned" by Infinity Electronics Ltd, then their license and allowed use of these items can be revoked at any time without prior notice at the sole discretion of Infinity Electronics Ltd. Any negative effects such as the inability to use any physical products is not the responsbility of Infinity Electronics Ltd. The customer agrees and accepts to the reasonable use and distribution of any software, firmware or non-physical product when they make the purchase and agree to any possiblity of their use being revoked.
Usage
When purchasing any software or firmware or any non-physical product from Infinity Eelctronics Ltd, unless otherwise stipulated in writing, the license purchased entitles the customer to a single use application of the said purchased item on any physical device that they have purchased with it or had it installed on. Should the physical device fail under warranty, the software license is transferred to any replacement physical product. The license entitles the customer to make use of all features purchased, at the level of functionality and open-natured architecture given to the customer at the time of sale (or via any updates during the life of the software). The software instance may not be ported or transferred to any other device without the implicit acceptance, approval and knowlege of Infintiy Electronics Ltd. The customer agrees not to try and break any element of product purchased or sourced from Infinity Electronics Ltd. The customer agrees not to hack or misuse or distribute/sell/supply said software for profit or any monetary or equivalent currency whereby others may benefit from the product whilst it is being used for its intended purpose by the customer. The customer may sell as a second hand, faulty or other condition should they have a replacement or no longer have a need however it is forbidden for them to act as any form of broker, reseller or other entity. The customer will not use their Infintiy Electronics Ltd products for any ilelgal activity, assisting or funding or organising terrorism or other snactioned acts that may be punishable by law. If a customer is found to break any uses and they did not make any attempt to contact Infintiy Electronics Ltd, ignorance is not an acceptable excuse to avoid punishment, sanction or loss of said license of use.
General

The use of our site and any contracts formed are governed by English law. Overseas orders are automatically in agreement with, and are governed by, these laws. -
We shall not be responsible to you whether in contract, tort (including negligence) or otherwise for incidental, special, indirect or consequential loss or damage, any loss of profit (direct or indirect), loss of sales, loss of goodwill or reputation, loss of business, third party claims, pure economic loss arising out of or in connection of the performance or non performance of our obligations under these terms and conditions including such damage as may be reasonably foreseeable at the date you order the goods. -
We do not accept any liability for injuries or death caused by the use (or misuse) of any of the products we sell. In the event of any situations like this, you should contact the manufacturer directly. -
Our liability for any claim for loss or damage or death or any other situation shall be limited to the sum paid by you for the goods. -
A person who is not a party to these terms and conditions shall have no right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.
If any provision of these terms and conditions is found to be invalid or unenforceable by a court the invalidity or unenforceability of such provision shall not affect the other provisions of these terms and conditions. -
We may assign or transfer any of our rights or sub contract any of our obligations under these terms and conditions to any third party. You may not assign or transfer any of your rights or sub contract any of your obligations under these terms and conditions except with our specific permission in writing. -
If any monies are rightfully owed to us by anyone who makes a purchase from us, the debt and any personal details we hold, shall be passed on to any third parties who assist or become responsible for, the return and clearance of said debt(s)/ -
We reserve the right to change these terms and conditions from time to time and any such changes will be communicated on our website. -
There may be links on our website to third party websites which we believe may be of interest to you. We do not have any control over the content of these websites nor can we be liable in respect of anything contained on these websites. -
These terms and conditions govern the entire trading relationship between you and ourselves and will remain in force for the duration of our trading relationship. -
All intellectual property rights (including use of trade marks) shall be solely owned by us. You are permitted only to use material on this website as expressly authorised by us or our licensors. Any unauthorised use of material on this site is strictly prohibited. -
We will use reasonable endeavours to verify the accuracy of any product or pricing information which we place on the site but we make no warranties (whether express or implied) in relation to the accuracy of such information). -
We may refuse to trade or to terminate our trading relationship by giving you notice of at least 1 (1) day. This does not affect your obligation to repay any amounts you owe to us. -
These Terms and Conditions supersede all previous Terms and Conditions, representations, undertakings and agreements. You accept them in their entirety when you place an order with us.

Orders

Your order will be accepted by us, and a contract will then be formed between us, when we despatch the goods to you. -
All orders placed through with Infinity Electronics Ltd are subject to our acceptance of the order. -
When you submit an order to us on our website you will receive a 'bounce back' confirmatory email of this order saying that we are processing your order. You will then receive a second email from us acknowledging your order and giving you estimated timescales for delivery. You should check both emails for accuracy and let us know immediately if there are any errors. Neither of these emails constitute acceptance of the order by us. Your order will be accepted by us (and a contract will then be formed between us) when we despatch the goods to you. Title to the goods will pass to you on delivery. -
Promotional codes are codes that enable customers to obtain benefits such as discounts, free delivery and free gifts. These codes are non-transferable so may only be used by the person to whom they are issued and must only be used in accordance with their terms and conditions of use. If you use a promotional code to claim a promotional benefit, you must first check that it was issued to you and that you are eligible to use it. By using it to claim a promotional benefit you will be confirming that:-

If, before accepting your order, we find that you are not entitled to use a discount code or do not meet all the terms and conditions of its use, we may reject your order or alternatively process it without the promotional benefit being applied. If, after accepting your order, we find that you were not entitled to use the code or did not meet all the terms and conditions of its use, we may reverse the benefit that you obtained. If you transacted on a cash basis e.g. by debit or credit card, we may take a further payment, equivalent to the value of the benefit obtained, from the card used. -

Refunds
- If purchasing through an approved retailer of Infinity Electronics Ltd products, returns and refunds are governed by the policies of that retailer.
- When purchasing anything directly from Infinity Electronics Ltd, refunds and returns are only accepted for faulty products or items that do not work as promised in any sales/marketing materials or arrive in a non-functional condition (known as Dead on Arrival "DOA").
Payment and Order Processing

Whilst it is our intention to keep our website up to date and error free, product description or pricing errors may occur. If we discover such an error after you have submitted an order to us, we will contact you prior to accepting your order with the correct details. You may then either cancel your order or re-confirm it based on the correct information. If we are unable to contact you, we will treat your order as cancelled. If a product price, version or other detail changes shortly after you made a purchase, no actions will be taken as products and their pricing, are subject to change without any notice.
