Product Repair Terms
The following terms and conditions are between you and Infinity Electronics Ltd and are agreed to at the point of order completion by the customer. These terms outline the commitment by Infinity to repair faulty products and the limitations and exclusions Infinity decides to impose on any said services. These terms and conditions are valid globally regardless of country of purchase or customer origin.
These terms do not undermine your consumer rights and are part of a value-add service offered by Infinity to ensure, withinr easonable grounds, an ongoing commitment to maintain operational product during the lifecycle and production period for products actively sold by Infinity.
Support - Infinity offers a 12 month warranty for all products, some products ship with a 24 month or 36 month warranty as standard and 24 and 36 month warranty packages can be purchased and applied to already purchased Infinity products (one package per product). Within the warranty period of a product, Infinity will offer free Technical support via email and/or post to assist and answer any customer technical questions and to assist customers maintain operability of their Infinity products.
Infinity offers inspection services whereby the customer, at their own cost, sends an Infinity product (that
they believe to be faulty or in other inoperable condition) back to Infinity for inspection and
diagnostics - Infinity offers the inspection at no extra cost to the customer however dependent on the
delivery service chosen by the customer and the time of year (such as International Holidays) and existing
workload, inspections can take up to, or more than, 30 calendar days from receipt of the returned product(s).
The inspection is not a fix, it merely identifies potential causes for performance loss or inoperability and then provides a report to the customer with recommended actions to rectify said causes.
Service - If requested, or even recommended as part of an Inspection, Infinity can perform a service on a product to restore it to operational condition. Dependent on the product and level of service required, Infinity would charge a fee which is calculated at the time of the required service. Once agreed and paid by the customer, Infinity performs the service and re-tests the product to ensure operatbility is restored. Infinity then returns the product to the designated customer address.
Data Transfer and Migration -
Infinity have staff who can transfer and migrate data in the event a customer wants a backup or wishes to
upgrade and take their personal data with them. A customer would send their product to Infinity with
instructions of what they want transferred/migrated and Infinity would charge a fee (calculated at the time
of the request based on the product, the service requested and amount of data in question). Once paid by the
customer, Infintiy performs the service and returns the original - and new - products back to the customer.
Please Note:- during any transfer or migration procedure, data loss or corruption can occur. Infinity does not accept any blame, liability or responsibility for this happening. As part of the service, any data on the original product sent by the customer, will be deleted. Please ensure a suitable backup, or lack of need, of this original data is in place before sending back to Infinity as the loss of data is irreversible.
Repair - If an Infinity product has a fault that requires repair, Infinity (and only Infinity) will carry out the repair in line with conditions as listed on this website for qualifying products. The repair will see all original components reusable within the product so as to return its operability. If parts need to be replaced, some of (or all) of the replacement parts service will be envoked. This may then require fees to be paid by the customer to facilitate this. Fees and their amounts will be confirmed at the time, if they are required.
Requirements of Customer
Customers who wish to send items back to Infinity do so at their own risk. Customers are solely responsible for items arriving back at Infinity in such a condition that Infinity can carry out the requested service(s) as offered in this website. Infinity accepts no liability or blame if items are lost, damaged or arrive late. Equally if items arrive in a condition whereby Infinity cannot carry out said works, customer is responsible for this and may choose for the product to be send back, to pay Infinity for a replacement product service or to buy a new product outright at full price.
It is the customer responsibility to backup all existing data, software, and programs, and to erase all existing data before receiving services. Infinity is not responsible for loss, recovery, or compromise of data, programs or loss of use of equipment arising out of the services provided by Infinity. You represent that your product does not contain illegal files or data and conforms to the usage policy you agree to when purchasing an Infinity product. You also agree that your product has not been used for any illegal activity.
Abandoned Property. Unless you provide alternative instructions, Infinity will ship your repaired or replacement product to the mailing address you provided when you requested your service(s). If your product is returned to Infinity because delivery could not be completed at the address given, Infinity will attempt to contact you for an alternative mailing address. If you do not provide an address at which Infinity or its agent may deliver your product within 10 working days after the original delivery attempt, Infinity will notify you that it considers your product to be abandoned. Infinity will send notice to the mailing address you provided when you made your request. In the event that your product is abandoned, Infinity may dispose of your product in accordance with applicable provisions of law, and, specifically, may sell your product at a private or public sale to pay for any outstanding service performed. Infinity reserves its statutory and any other lawful liens for unpaid charges.
Information on Service. During the service ordering process you must provide a description of the issue that is affecting your product, so that Infinity understands and may replicate the issue. Failure to do this may result in an inability to assist you or for your product to be returned in its same condition and you may incur a fee from Infinity for the time taken, without your assistance, to provide support and assistance to you to fix your issue(s).
You must provide Infinity with the disclosure of modifications (lawful and unlawful) to your product and any changes that may not be allowed within your usage and warranty terms. Failure to to so may result in a lack of any repairs or replacements by Infinity. If your product is found to have modifications or changes that break the law and you have not informed Infinity of this, Infinity will have to inform the law enforcement of your country of residence about the product and its potential use as a result of the modifications/changes. Equally, some modifications or changes may violate Infinity partners, such as Google, with respect to what you can or cannot do with cloud services, apps or even Android provided by Google. Infinity will not be responsible for any damage to the product that occurs during the repair process that is a result of any unannounced modifications or repairs or replacements not performed by Infinity If damage results, Infinity will seek your approval for any additional costs for completing service. If you decline this, Infinity may return your product unrepaired in the damaged condition without any responsibility; furthermore depending on the situation, Infinity may keep possession of your product if it violates usage and/or warranty terms or may even have to hand it to the authorities of your country if illegal use has been seend on the product.
Parts and Labour -
Infinity may provide its own parts and workforce for any works and services offered however on occasion (and
only at the sole discretion of Infinity) third party parts and workforce may be used to carry out services
such as inspections, diagnostics, services, data transfer & migration, repairs, replacements and more.
Infinity may use parts from other Infinity products (possible not the same model) or even from other third party produts when carrying out works and services for customer products. In any event that replacement parts are used, the original parts are kept by Infinity as their possession and ownership and the replacement parts are passed to the customer as their possession and ownership. Infinity, at their sole discretion, may charge a shipping fee and replacement parts fee (depending on the parts, work required and other factors).
No warranty is provided for any replacement parts. A product does not get extensions to its warranty, the use of replacement parts does not extend or shorted the warranty, compared to its beginning or duration left at the point of works carried out on the product send by the customer.
Works carried out by Infinity are done so by mail-in only. Customers must send products back to Infinity and once complete, Infinity sends products back to customers. Any attempts to have works done by any other means are excluded.
Infinity products that have had their warranty period expire are excluded from any works. Warranty packages cannot be bought for products already requested for service works to be carried out (and already confirmed by Infinity that they are out of warranty) however you will still be charged for the warranty package order should you order a package for the purpose of trying to get service works done.
Infinity service works are only carried out for end users who are 18 years of age or older.
Infinity reserves the right to change services, options, costs and any other detail at any time without prior notice. This website will be updated accordingly should anything change.
Payment - Any fees and their amounts, are set and decided by Infinity at their sole discretion based on the information provided by the customer, the product in question, the service(s) requested and the situation and other factors. Payment is required in advance for any part of the requested servie(s) to commence.
Refunds - For any purchases other than for the product itself, Infinity does not offer refunds. Purchases for additional warranty packages, repairs, replacements or anything does not qualify for a refund.
Warranty - No additional warranty or guarantee is provided for any repair, replacement or other service offered by Infinity. Any works or parts or advice provided by Infinity merely fixes issues reported to Infinity but not guarantees for any period of time in terms of the fix lasting and operability being maintained, are offered.
Warranty Disclaimer -
For Customers in Europe: THE EXPRESS WARRANTIES,
CONDITIONS AND REMEDIES SET OUT IN THIS AGREEMENT ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES,
CONDITIONS, TERMS, UNDERTAKINGS, OBLIGATIONS AND REPRESENTATIONS, WHETHER ORAL OR WRITTEN,
STATUTORY, EXPRESS OR IMPLIED. INFINITY SPECIFICALLY DISCLAIMS AND EXCLUDES ANY AND ALL STATUTORY AND
IMPLIED WARRANTIES, CONDITIONS, TERMS, UNDERTAKINGS, OBLIGATIONS AND REPRESENTATIONS RELATED TO OR
ARISING IN ANY WAY OUT OF THIS AGREEMENT, INCLUDING ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTIBILITY,
SATISFACTORY QUALITY, CARE, SKILL OR FITNESS FOR A PARTICULAR PURPOSE.
For Customers outside of Europe: TO THE EXTENT PERMITTED BY LAW, THE EXPRESS WARRANTIES, CONDITIONS AND REMEDIES SET OUT IN THIS AGREEMENT ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, CONDITIONS, TERMS, UNDERTAKINGS, OBLIGATIONS AND REPRESENTATIONS, WHETHER ORAL OR WRITTEN, STATUTORY, EXPRESS OR IMPLIED. TO THE EXTENT PERMITTED BY LAW, INFINITY SPECIFICALLY DISCLAIMS AND EXCLUDES ANY AND ALL STATUTORY AND IMPLIED WARRANTIES, CONDITIONS, TERMS, UNDERTAKINGS, OBLIGATIONS AND REPRESENTATIONS RELATED TO OR ARISING IN ANY WAY OUT OF THIS AGREEMENT, INCLUDING ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTIBILITY, SATISFACTORY QUALITY, CARE, SKILL OR FITNESS FOR A PARTICULAR PURPOSE.
Limitation of Liability - INFINITY DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN, INCLUDING BUT NOT LIMITED TO ANY LIABILITY FOR PRODUCT NOT BEING AVAILABLE FOR USE, LOST PROFITS, LOSS OF BUSINESS OR FOR LOST, CORRUPTED, OR COMPROMISED DATA OR SOFTWARE, OR THE PROVISION OF SERVICES. EXCEPT AS EXPRESSLY PROVIDED HEREIN, INFINITY WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCT, INFINITY IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AMOUNT OF YOUR ORDER. IN CONSUMER CASES, THE LIABILITY FOR (1) PERSONAL DEATH AND INJURY AND (2) FRAUD MAY BE WIDER THAN NEGLIGENCE CAUSED LOSS AND IN SUCH CASES INFINITY DOES NOT SEEK TO EXCLUDE THIS LIABILITY.
Errors for Belgium - For residents of Belgium: Please note that Infinity will be unable to facilitate any cancellation requests for your order, pursuant to Article 79 § 1 Trade Practices Act 1991.
Terms and Cancellation -
Infinity reserves the right to change this Agreement at any time.
Upon acceptance of a service order, Infinity initiates service and consequently a
service order may not be cancelled and you cannot withdraw from the contract or receive a refund. All payments
are made upfront prior to any works commencing.
For residents of Europe, outside Belgium : If you are a consumer, you agree that because Infinity starts service upon acceptance of your order, you may not exercise the right of withdrawal. For residents of Belgium: Please note that Infinity will be unable to facilitate any cancellation requests for your order, pursuant to Article 79 § 1 Trade Practices Act 1991.
Unforseeable Terms -
If any of the aforementioned terms are held by a court or other tribunal of
competent jurisdiction to be void or unenforceable, such term shall be limited or
eliminated to the minimum extent necessary and replaced with a valid provision that best
embodies the intent of the term, so that the terms shall remain in full force and effect.
Equally on the subject of Waivers; Infinity's failure to insist on or enforce strict performance of this Agreement shall not be construed as a waiver by Infinity of any provision or any right it has to enforce these policies, nor shall any course of conduct between Infinity and you or any other party be deemed to modify any provision of these terms. And these terms shall not be interpreted or construed to confer any rights or remedies on any third parties.
Conflict of Language - In the event of a conflict between different translations of these terms, the English translation will prevail. Certain support services and related documents may be available in English only. This is true of any communication between Infinity and its customers, parties used for works or for the product itself where the menu and language used is not in English when received by Infinity.
Force Majeure - Complete Agreement; Force Majeure. This Agreement governs service transactions accepted by Infinity. No other oral or written terms or conditions apply. Infinitydoes not authorize any variance or modification of this Agreement. Infinity is not responsible for any failures or delays in performing service or delivering your product or a replacement product that are due to events outside Infinity’s reasonable control.
